CHANGING OFFERS OF COMPENSATION
Article 3 - THE REALTORSŪ CODE OF ETHICS
Standard of Practice 3-1
REALTORSŪ, acting as exclusive agents or brokers of sellers/ landlords,
establish the terms and conditions of offers to cooperate. Unless expressly
indicated in offers to cooperate, cooperating brokers may not assume that the
offer of cooperation includes an offer of compensation. Terms of compensation,
if any, shall be ascertained by cooperating brokers before beginning efforts to
accept the offer of cooperation.
Standard of Practice 3-2
REALTORSŪ shall, with respect to offers of compensation to another REALTORŪ,
timely communicate any change of compensation for cooperative services to the
other REALTORŪ prior to the time such REALTORŪ produces an offer to
purchase/lease the property.
Standard of Practice 3-3
Standard of Practice 3-2 does not preclude the listing broker and cooperating
broker from entering into an agreement to change cooperative compensation.
SECTION FIVE DIVISION OF COMMISSION
Section 5 COMPENSATION SPECIFIED ON EACH LISTING:
This shall not preclude the listing broker from offering any Multiple Listing
Service Participant compensation other than the compensation indicated on any
listing published by the Multiple Listing Service provided the listing broker
informs the other broker in writing in advance of his producing an offer to
purchase, and provided that the modification in the specified compensation is
not the result of any agreement among all or any other Participants in the
Multiple Listing Service. Any superseding offer of compensation must be
expressed as either a percentage of the gross sales price or as a flat dollar
amount.
